Fereshteh Tabanian, the lawyer of Abbas Daryis, received a death sentence for claiming to possess weapons that were not proven.
Fereshteh Tabanian, the lawyer of Abbas Daryis, spoke in interviews with the website Didban Iran about the criticisms she raised in her client’s case and mentioned that the retrial was not considered.
Ms. Tabanian mentioned that one of the criticisms was that testimonies that had not been brought to the judicial authorities. Regarding other issues, she referred to the ballistic examination. Weapons were found in the neighbor’s house, but it was not proven that they belonged to her client. The ballistic examination indicated that it was unclear if the gun had been fired as no bullets were found. Forensic medicine was also among the issues she raised. Forensic medicine had stated that the gap in the body of the martyr Sayyadi indicated that he had been shot from a closer distance. On the other hand, the eyesight of her client was weak, and he could not have shot with such precision even with glasses. Unfortunately, none of these evidences were addressed in court, and the death sentence was issued.
Mrs. Tabanian mentioned in part of the conversation regarding Mr. Daris’ case that this case has become politicized. If this case was dealt with legally and examined based on legal laws, it could have been discussed and possible to revoke the death sentence. Unfortunately, it is a politicized case. However, we have requested clemency and hope that our request will be approved.
Mrs. Tabanian stated that despite the consent of the victim’s family and the flaws in the case, the death sentence was issued.
Abbas Daris, born in 1973, was accused of involvement in the killing of Reza Sayadi Koochak, the commander of the Special Police Forces. It is said that this commander was killed on the 27th of Aban month, 1398, in clashes between security forces and protesters near Chamran Town in Mahshahr.
