Judiciary Chief: Death Penalty for Moharebeh is at the Judge's Discretion

The head of the judiciary states that the death penalty for ‘moharebeh’ is at the discretion of the judge.

Mohseni Ejei mentions that in Article 282 of the Islamic Penal Code, the punishment for ‘moharebeh’ can be one of four: execution, crucifixion, amputation of the right hand and left foot, or exile.

Article 283 also clarifies that the choice of any of these four punishments is at the judge’s discretion. This is the existing law, and judges must act according to it.
