Farshteh Tabaniyan, Abbas Dris’s lawyer, stated that the charge of waging war was based on the claim of possessing a weapon, which was not proven.
In an interview with the Didban Iran website, Farshteh Tabaniyan, Abbas Dris’s lawyer, discussed the flaws she sees in her client’s case and mentioned that the appeal for a retrial has not been considered.
Ms. Tabaniyan mentioned that one of the issues was confessions that were not made in front of a judicial authority. In another instance, we pointed out the weapon examination. The weapon was found in a neighbor’s house, and it was not proven that the weapon belonged to my client. The weapon’s examination stated that it was unclear if the shooting was from this weapon since no bullet was found. The forensic report was also one of the points we raised. The forensic report indicated that the wound on martyr Sayadi’s face suggested he was shot from a closer distance. On the other hand, my client’s eyesight is weak, and even with glasses, he couldn’t have shot with such accuracy. Unfortunately, none of this evidence was accepted in court, and the death sentence was issued.
Ms. Tabaniyan, in part of this conversation about Mr. Dris’s case, says that this case has become political. If this case were legal and examined based on legal principles, there would be room for discussion, and the death sentence could be overturned. But unfortunately, the case is political. However, we have requested a special pardon and hope that our request will be approved.
Ms. Tabaniyan stated that despite the victim’s family’s satisfaction and the case’s deficiencies, the death sentence was issued.
Abbas Dris, born in 1973, was accused of being involved in the killing of Reza Sayadi Koyekh, the commander of the special police guard forces. It is said that this commander of the special police guard forces was killed on November 18, 2019, during a clash between security forces and protesters near Chamran Jarrahi Mahshahr.
