The lawyer for Tomaj Salehi stated that the Revolutionary Court of Isfahan has sentenced Tomaj Salehi to death.
Amir Raisiyan, a legal attorney, in an interview with Sharq Network, mentioned the issuance of the sentence for Tomaj Salehi, a detained singer in Iran, by the Revolutionary Court of Isfahan. He stated that Branch One of the Revolutionary Court of Isfahan, in an unprecedented move, did not implement the Supreme Court’s ruling regarding Tomaj Salehi’s 2022 case. By considering this ruling as advisory and emphasizing the independence of the trial court, it sentenced Tomaj Salehi to the maximum penalty, which is execution, on the charge of spreading corruption on earth.
He continued, stating that the Revolutionary Court of Isfahan considered the charges of aiding in rebellion, gathering and collusion, propaganda against the regime, and incitement to chaos under Article 512 of the Penal Code as all being instances of spreading corruption on earth under Article 286 of the Penal Code. By emphasizing the extent of the corruption, it issued a death sentence for Mr. Salehi. This is despite the fact that previously the same branch had not confirmed the extent of the charge of spreading corruption on earth. However, the stranger point is that the trial court has also considered additional penalties for the death sentence and has sentenced Tomaj Salehi to a 2-year ban on leaving the country, a ban on artistic activities, and participation in behavior management and skill classes by the judiciary of Isfahan. This court has also declared that the suspended sentence of Tomaj Salehi is enforceable.
He stated that they will definitely appeal the issued sentence for Tomaj Salehi, saying the reality is that the trial court’s ruling contains clear legal contradictions. The contradiction with the Supreme Court’s ruling is considered the most important and at the same time the strangest part of this ruling. The trial court considered the Supreme Court’s ruling as advisory, despite the Supreme Court reviewing Tomaj Salehi’s case as the appellate authority and ordering the trial court to rectify deficiencies, emphasizing that given the consideration of two penalties for one act, Tomaj Salehi’s charges should be reduced from six to three counts. The Supreme Court also emphasized that Tomaj Salehi’s case would be eligible for the announced amnesty. However, not only did these events not occur, but new charges were added to Tomaj Salehi’s case, and he was sentenced to the maximum penalty.
Raisiyan, regarding the published news about Tomaj Salehi’s amnesty and the reduction of his sentence, said all these reports are false.
