The Judiciary Chief: The Death Penalty for Moharebeh is at the Judge's Discretion

The head of the judiciary states that the death penalty for warfare is at the judge’s discretion.

Mohseni Ejei mentioned that according to Article 282 of the Islamic Penal Code, the punishment for warfare is one of four penalties: execution, crucifixion, amputation of the right hand and left foot, or exile.

Article 283 also clarifies that the choice of any of the four mentioned punishments is at the judge’s discretion. This is an existing law, and judges must act based on it.
